29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Bajer Underground, LLC at 2600 9th Avenue Southeast, Watertown, SD 57701: On or about and at times prior to December 17, 2021, the employer did not ensure that employees that were entering a trench excavation greater than four feet in depth were provided with a safe means of egress not requiring more than 25 feet of travel. This condition exposed employees to hazards associated with safe egress while working within an unprotected excavation.

This condition exposed employees to struck-by and cave-in hazards associated with a trench wall collapse.

29 CFR 1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) Bajer Underground, LLC at 2600 9th Avenue Southeast, Watertown, SD 57701: On or about and at times prior to December 17, 2021, the employer did not ensure that employees were removed from hazardous area within a vertical walled unprotected trench excavation. An employee was working within the unprotected excavation that was deeper than five feet and no protective system installed and in plain view of the competent person. This condition exposed the employee to cave-in hazards associated with trench wall failure.
