29 CFR  1910.147(c)(4)(i): Procedures were not utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:   a) Grand Basket Inc.,  13550 E. Smith Road, Building 1, Suite 200B, Aurora, CO 80011:  On and about December 17, 2021, the employer did not ensure that procedures for the control of hazardous energy sources were used by employees tasked with servicing and/or maintaining the company's blow-fill machinery at the facility.  A manager, trained as an authorized employee in LOTO, did not follow the steps to release any/all stored energy and verify isolation on a blow-fill machine while troubleshooting the machinery.  Energy sources used at the facility include but are not limited to, electricity, pneumatic and mechanical energy.

29 CFR  1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  a) Grand Basket, LLC, 13550 E. Smith Road, Building 1, Suite 200B, Aurora, CO 80011: On and about December 17, 2021, the lockout procedure for Blow-fill Machine #1 was deficient in that a specific statement of the intended use of the procedure and who is authorized to use the procedure was not defined/included to protected employees from hazards created by unguarded moving parts when servicing/troubleshooting the machinery.

29 CFR  1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy for energy isolation and control:  a)  Grand Basket, LLC, 13550 E. Smith Road, Building 1, Suite 200B, Aurora, CO 80011: On and about December 17, 2021, untrained employees were allowed to completed lockout at the facility. Although the employer designated some employees as "authorized employees", they had not participated in training classes to qualify as such. Temporary workers were allowed to conduct cleaning operations while the blow-fill machines were still on or had not fully released stored energy thus exposing employees to hazards created by moving or re-energized parts.

29 CFR  1910.147(d)(6): Prior to starting work on machines or equipment that had been locked out or tagged out, the authorized employee did not verify that isolation and deenergization of the machine or equipment had been accomplished:   a) Grand Basket, LLC, 13550 E. Smith Road, Building 1, Suite 200B, Aurora, CO 80011: On and about December 17, 2021, the Operations Manager did not ensure the stored energy was released from the drum roller of the belt on Blow-fill Machine #1. The manager shut off the machine, and removed the guard covering the belt and pulley assembly to conduct maintenance and servicing.  The mechanical energy had not fully dissipated  and the manager was injured when his hand was inadvertently pulled into/caught by the rotating belt.

This condition exposed employees to  hazards such as; but not limited to, eye, dermal and/or respiratory hazards.

29 CFR  1910.219(c)(3): Vertical or inclined shafting seven -7 feet or less from floor or working platform was not enclosed with stationary casing:     a) Grand Basket, LLC, 13550 E. Smith Road, Building 1, Suite 200B, Aurora, CO 80011: On and about December 17, 2021, although the vertical incline belt of the blow-fill machine #1 and #2 were equipped with a guard, it was inadequate in that the shaft was not guarded by a full enclosure. The opening in the back of the guarding measured approximately 4 inches. Employees who routinely access the area when removing foam fiber or when completing maintenance/servicing activities were not protected from hazards created by  rotating parts.
