OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by and caught-between hazards: a. On or about 12/20/2021, at work site stairwells, employees were exposed to struck-by and caught-between hazards while working underneath concrete stairwells sections to cut and grind the structural steel plates that held the concrete stairwell sections in place.

29 CFR 1926.1060(a)(1): The employer did not ensure that each employee was trained by a competent person which would enable each employee to recognize hazards related to ladders and stairs, and the procedures to follow to minimize those hazards. a. On or about 12/20/2021, at work site stairwells, employees were exposed to fall hazards of up to 6 feet when working from an A-frame ladder and had not been trained.
