29 CFR 1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. a) The Model Group, Inc. doing business as Model Construction at the jobsite locate at 107 East Main Street in Van Wert, Ohio; On or about December 13, 2021 the employer did not fully implement engineering controls, work practices, and respiratory protection specified for tasks on Table 1 of paragraph (C). Employees operating handheld power chipping tools were exposed to hazards associated with crystalline silica in that the Bosch hand held power tool was not equipped with a water delivery system or a shroud and dust collection system in conjunction with a respirator with a protection factor of 10 when being used outdoors for greater than 4 hours.
