29 CFR 1910.28(b)(1)(i)(C):The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by a personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: a) On or about 12/21/2021, on site located at 1070 Erie Avenue in North Tonawanda NY, an employee was exposed to falls while working near edge of a shipping container that was 12 feet in height. Employee was not using personal fall protection equipment while securing straps to spreader bar to prepare shipping container for crane hoisting. NO ABATEMENT CERTIFICATION REQUIRED
