29 CFR  1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  A.) On December 16, 2021 employees were not trained in the safe operation and avoidance of hazards while operating a JLG brand rough terrain forklift in that they were working from a basket that was not adequately attached to the forks of the rough terrain forklift.

29 CFR  1926.451(c)(2)(v):Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  A.) On December 16, 2021 employees were exposed to fall and struck by hazards in that they were working on a basket that was not adequately attached to the forks of a JLG Rough Terrain Forklift.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  A.) On December 16, 2021 employees were working from the basket that was being lifted by a JLG Rough Terrain Forklift while not utilizing any type of fall protection system. Fall heights were estimated to be in excess of 20' from the basket to the ground.

29 CFR  1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  A.)On December 16, 2021 employees were exposed to fall hazards while working on a barn beam while not utilizing any type of fall protection system. Fall height was measured to be 8'-10".

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  A.) On December 16, 2021 the employer did not have any type of fall protection training program in that employees were working from a barn beam in excess of 8' from the next lower level and working from a platform that was being lifted by a JLG rough terrain forklift without any type of fall protection system.
