29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform):  On or about December 22, 2021, employees were exposed to a fall hazard to the ground below while performing masonry activities without the scaffold platform being fully planked.

29 CFR  1926.1060(a)(1)(iii): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways:   On or about December 22, 2021, and at times prior thereto employees were exposed to a fall hazard while using two portable A-frame ladders on the second tier of a scaffold without guardrails on the top tier to access the roof of the commercial construction building.
