29 CFR  1910.28(b)(1)(i):  Unprotected sides and edges.  Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by guardrail systems, safety net systems, or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:  At a facility located at 4875 W Prospect Avenue, Appleton, WI 54914; the employer did not ensure employees on walking-working surfaces with unprotected sides or edges greater than 4 feet above a lower level were protected from falling. Employees shoveling and removing snow from the lids of outdoor loading-hoppers were exposed to falls of approximately 6.5 feet to the loading ramp surface or approximately 9.5 feet to the ground level when working near the unprotected edges of the loading-hoppers.

29 CFR  1910.28(b)(3)(ii): (ii) Each employee is protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems:  At a facility located at 4875 W Prospect Avenue, Appleton, WI 54914; the employer did not ensure employees working on the platform around the mixer discharge chute were protected from tripping into or stepping into a hole that was less than 4 feet above the lower level. Employees walking and working on the  mixer platform were exposed to slips and trips into open floor holes around the mixer's discharge chute.

29 CFR  1910.28(b)(5)(i):  The employer must ensure each employee on a runway or similar walkway is protected from falling 4 feet (1.2 m) or more to a lower level by a guardrail system:  At a facility located at 4875 W Prospect Avenue, Appleton, WI 54914; the employer did not ensure employees on a runway with unprotected openings greater than 4 feet above the lower level were protected by a guardrail system. Employees walking and working on a runway along the northside frame of the indoor mixer equipment were not protected from openings in the frames of the equipment.

29 CFR  1910.29(b)(1):  The employer must ensure the top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface.  The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section:   At a facility located at 4875 W Prospect Avenue, Appleton, WI 54914; the employer did not ensure the top rails of the guardrail system were 42 inches, plus or minus 3 inches, above the walking-working surface.  The platform around the mixer discharge chute was provided with a guardrail system where the top rails were approximately 37 inches above the walking-working surface. Employees working on the platform were exposed to fall of greater than 10 feet to the lower levels.

The use of a fall protection system is not required for a repair pit, service pit, or assembly pit that is less than 10 feet (3 m) deep, provided the employer followed 29 CFR 1910.28(b)(8)(i) through 1910.28(b)(8)(iii):  At a facility located at 4875 W Prospect Avenue, Appleton, WI 54914; a service pit in the maintenance garage was not provided with means of fall protection; nor was it provided with floor markings, warning lines, posted caution signs and limited access for authorized employees with training in accordance with 1910.28(b)(8)(i) through (iii). Employees working in the maintenance shop around the service pit were exposed to falls of approximately 4 feet 9 inches into the pit.

29 CFR  1910.303(g)(1):  Sufficient access and working space shall be provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment:  At a facility located at 4875 W Prospect Avenue, Appleton, WI 54914; the employer did not provide sufficient access and working space to circuit breaker electrical panels located in the laboratory building. Steel barrels, bucket and other materials were stored in front of the breaker panels, did not provide at least three feet of clear working space, and did not permit ready and safe operation and maintenance of the breaker panel.

Containers of waste oil were not labeled with the product identifiers (e.g., "Waste Oil") and were not labeled with information regarding hazards of the waste oil. Containers of break wash and airline alcohol were not labeled with information regarding hazards of the chemicals.
