29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) HOM Furniture, Inc., at 2601 South Louise Avenue Sioux Falls, SD 57106: On or about and at times prior to January 6, 2022, the employer failed to ensure that employees who accessed the pallet shelving system in the receiving area of the facility utilized a fall protection system while exposed to fall hazards greater than four feet when placing and/or removing seasonal items from the storage racks. This condition exposed employees to fall hazards ranging from eight to 13 feet to the concrete below.

29 CFR 1910.106(d)(5)(iii): Flammable liquids were not kept in closed metal containers stored in a storage cabinet or in safety cans: a) HOM Furniture, Inc., at 2601 South Louise Avenue Sioux Falls, SD 57106: On or about and at times prior to January 6, 2022, the employer did not store gasoline used for maintenance operations in an approved closed metal container in that a five gallon plastic gas can, with at least three gallons of gasoline was being stored, long term in a closet, off-gassing, with no ventilation. This condition exposed employees to fire and explosion hazards associated with combustion of vapors off-gassing from the plastic gas can.

This condition exposed employees to injuries associated with trips and falls while attempting emergency egress through a dark stairwell.
