29 CFR 1910.333(a)(2): When exposed live parts are not de-energized, other safety-related work practices were not used to protect employees who may be exposed to the electrical hazards involved.   a) On January 7, 2022 and at times prior thereto; an employee worked on the ground between a tree and overhead power lines using a Tucker ECO 50 pole to remove lights from the tree.  The pole was not rated or designed for use around power lines, and was extended 40 to feet 50 feet when the upper portion came within 10 feet of the 7200 volt phase to ground overhead line.   Note) Certification and documentation of corrective actions are required for this item.  Abatement Note:  Live parts to which an employee may be exposed must be deenergized before working on or near them, unless the employer can demonstrate that deenergizing introduces additional or increased hazards or is infeasible.  Only then, may other safety-related work practices be used to protect employees.
