29 CFR  1926.451(a)(1): Each scaffold and/or scaffold component was not capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it:  (a) On January 7, 2022,  while in the process of installing precast chimney caps on a residential property located at 1842 S Ogden St. Denver, CO, two employees working from a tubular steel framed scaffold that was not fully planked were not protected from a fall hazard.  Both employees fell approximately 28 feet from the top of the work platform to the ground below, when the wooden planks failed.

29 CFR  1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:   (a) On January 7, 2022, the working platform/decking of a tubular steel framed scaffold was not fully planked and/or the remaining open space between the planks were no more then an inch to protect employees from a potential fall hazard. Employees tasked with installing precast chimney caps on a residential property located at 1842 S Ogden St. Denver, CO 80210, were exposed to fall hazards from a height of 28 feet from the top of the working surface to the ground below.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  (a) On January 7, 2022, the employer failed to ensure that visual inspections to identify deficiencies that could affect the structural integrity of the tubular steel framed scaffolding and it components used by two employees when installing precast chimney caps on a residential property located at 1842 S Ogden St. Denver, CO 80210 was inspected by a competent person, before each work shift or anytime the scaffold was relocate/moved. Employees were exposed to fall hazards from a height of approximately 28 feet from the working surface to the ground level).

29 CFR  1926.452(c)(2): All brace connections were not secured:  (a) On January 7, 2022, while in the process of installing precast chimney caps on a residential property located at 1842 S Ogden St. Denver, CO 80210, employees were exposed to a fall hazard while using a tubular steel framed scaffold that was missing one brace connection, and was not properly secured.   Employees were exposed to fall hazards of approximately 28 feet, the top of the working surface to the ground below.
