29 CFR  1910.178(l)(1)(ii):The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck:  On or about January 12, 2022 an employee was permitted to operate a rough terrain fork truck prior to receiving training, exposing the employee to struck-by hazards associated with operating a powered industrial truck.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1926.451(f)(7):Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:  On or about January 12, 2022 a wood framed scaffold was not erected by experienced employees under the supervision and direction of a competent person qualified in scaffold erection, exposing the employee to the hazards associated with scaffold work, such as a fall, and possible collapse.    Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.451(g)(1)(vii):Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  On or about January 12, 2022 employees were not protected from a fall while working from a wood framed scaffold, exposing employees to a fall of approximately 25 feet. 29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  On or about January 12, 2022 employees performing residential construction activities were not protected from a fall while working around unguarded windows, and second floor open walls, exposing employees to a fall of 14 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
