29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one of the following: Guardrail system, safety net system, or personal fall arrest system:  On January 11, 2022, and times prior to, employees of Wineshipping.com,  LLC were exposed to fall hazards while working 13.5 feet above the lower level at a commercial building located at 13600 Shoreline Drive, Earth City, Missouri.  The employer did not ensure that employees utilized guardrail system, safety net or personal fall arrest system while staging pallets near a leading edge on the second level of the warehouse.

29 CFR 1910.176(a): Where mechanical handling equipment was used, sufficient safe clearances were not maintained for aisles where turns or passage must be made. Aisles and passageways were not kept clear and in good repair, with no obstructions across or in aisles that could create a hazard:  On January 11, 2022, and times prior to, employees of Wineshipping.com, LLC working in the warehouse were exposed to struck-by hazards at a commercial building located at 13600 Shoreline Drive, Earth City, Missouri.  The employer did not ensure aisles and passageways were kept clear, provided sufficient safe clearances and were maintained in good repair where mechanical equipment is used.

29 CFR 1910.178(I)(1)(ii): Prior to permitting an employee to operate a powered industrial truck, the employer shall ensure that each operator has successfully completed the training required by this paragraph (I), except as permitted by paragraph (I)(5):  On January 11, 2022, and times prior to, employees of Wineshipping.com, LLC operating powered industrial trucks in the warehouse were exposed to struck-by hazards at a commercial building located at 13600 Shoreline Drive, Earth City, Missouri.  The employer did not ensure that employees received a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and an evaluation of the operator's performance in the workplace prior to permitting each employee to operate a powered industrial truck.
