29 CFR  1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting respirator is fit tested prior to initial use, whenever a different respirator facepiece (size, style, make or model) is used, and at least annually thereafter.   a) St. John's Riverside Hospital at 967 North Broadway Yonkers, NY 10701:   The employer did not ensure that employees who are required to wear respirators were fit tested annually.  Employees working as Registered Nurses providing care to patients suspected or confirmed to be infected with the SARS-CoV-2 virus were provided and required to wear N95 respirators.  The violation occurred on or about 02/09/2022.  b) St. John's Riverside Hospital at 967 North Broadway Yonkers, NY 10701:   The employer did not ensure that employees who are required to wear respirators were fit tested whenever a different respirator facepiece is used. Employees working as Registered Nurses providing care to patients suspected or confirmed to be infected with the SARS-CoV-2 coronavirus, were provided with 3M N95, Halyard - Duckbill-style N95, Kimberly Clark N95, Makrite 9500 Preformed N95 and Makrite Sekura N95 respirators however the employer did not ensure the employees wore the respirator  they were  initially fit tested to wear. The violation occurred on or about 02/09/2022.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER CFR 1903.19.

NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE INSPECTION CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OF ABATEMENT FOR THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
