29 CFR 1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating, or moving parts of equipment exposed to contact by the employees or which otherwise created a hazard, were not guarded: On or about January 18, 2022, at the jobsite the employer permitted employees to operate a portable mixer that was not guarded, including but not limited to the following instances: a. The guard covering the gears, belt, and pulley system, at the back of the portable mixer machine was left open during operation. This exposed the employee to a caught in hazard. b. The front guard covering the mixer basin was removed while in the machine was in use. This exposed the employee to a caught in hazard.
