29 CFR 1926.501(b)(1):Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system. On or about January 18, 2022, on the top of a commercial building under construction in Lufkin, TX, employees were not utilizing a fall protection system, while working on a roof that was above 6 feet or more above the lower level and did not have protected side(s) or edge(s).

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. On or about January 18, 2022, on the side of a commercial building under construction in Lufkin, TX, employees did not have a ladder extending at least 3 feet above the edge of a roof that was above 6 feet or more above the lower level, and there was no other access to the roof which employees were working on.
