29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Worksite, 100 Military Ocean Terminal Street, Bayonne, NJ The employer required ship paint sprayers that mixed and sprayed flammable spray paints to wear 1/2 mask elastomeric negative pressure respirators with organic vapor cartridges. The employer failed to provide three employees performing mixing and spray painting operations with a medical evaluation to ensure they were capable of wearing a negative pressure respirator. Violation occurred on or about December 27, 2021, and thereafter.

29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) Worksite, 100 Military Ocean Terminal Street, Bayonne, NJ The employer required ship paint sprayers that mixed and sprayed flammable spray paints that contained chemicals including but not limited to zylene, and n-butyl acetate, and hexamethylene di-isocyanate, to wear 1/2 mask elastomeric negative pressure respirators with organic vapor cartridges. The employer failed to provide three employees performing this mixing and spray painting with an annual fit test in 2021 , within 1 year after their initial fit test. Violation occurred on or about December 27, 2021, and thereafter.
