29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Worksite,  100 Military Ocean Terminal Street, Bayonne, NJ  The employer required ship paint sprayers that mixed and sprayed flammable spray paints to wear 1/2 mask elastomeric negative pressure respirators with organic vapor cartridges. The employer failed to provide three employees performing mixing and spray painting operations with a medical evaluation to ensure they were capable of wearing a negative pressure respirator.   Violation occurred on or about  December 27, 2021,  and thereafter.

The employer failed to provide three employees performing this mixing and spray painting with an annual  fit test in 2021 , within 1 year after their initial fit test.   Violation occurred on or about  December 27, 2021,  and thereafter.
