29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  Med1Care of Toledo LLC worksite located at 240 Northcrest Drive, Napoleon, OH  43545:  On or about October 31, 2021 and at times thereafter, the employer did not ensure a written respiratory protection program was implemented with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). Employees were required to wear respirators throughout their work shift to help prevent the spread of COVID-19 and while providing care to suspected or confirmed positive COVID-19 residents. The employer did not ensure the requirements of medical evaluations and fit testing for all employee required to wear respirators in the workplace was implemented.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Med1Care of Toledo LLC worksite located at 240 Northcrest Drive, Napoleon, OH 43545:  On or about October 31, 2021 and at times thereafter, the employer did not ensure a medical evaluation to determine each employee's ability to use a respirator was provided before requiring the use. Employees were required to wear respirators throughout their work shift to help prevent the spread of COVID-19 and while providing care to suspected or confirmed positive COVID-19 residents.

Employees were required to wear respirators throughout their work shift to help prevent the spread of COVID-19 and while providing care to suspected or confirmed positive COVID-19 residents.
