On or about January 27, 2022, Ball Jackets, LLC DBA Just Ink Tees, did not have a written hazard communication program for employees exposed to hazardous chemicals, including, but not limited to Klean Strip acetone (flammable), and Nazdar adhesive spray (flammable).

29 CFR 1910.1200(f)(6): Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: 1910.1200(f)(6)(i) The information specified under paragraphs (f)(1)(i) through (v) of this section for labels on shipped containers; or, 1910.1200(f)(6)(ii) Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. a.) On or about January 27, 2022, Ball Jackets, LLC DBA Just Ink Tees, did not ensure that Tekmar TG 300 Spot Cleaning Gun containers filled with Klean Strip acetone (flammable) and used by employees in the printing room were labeled as Klean Strip acetone and included words, pictures, or symbols to describe the flammable and irritant hazards of the acetone.

If such hazards are present, or likely to be present, the employer shall: On or about January 27, 2022, Ball Jackets, LLC DBA Just Ink Tees, did not perform an adequate hazard assessment for employees working in the printing room in that, personal protective equipment was not required when using chemicals such as, but not limited to Klean Strip acetone (flammable).
