29 CFR 1926.602(d): The employer did not ensure that each employee operating a powered industrial vehicle had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. and as referenced by the note contained in 1926.602(d). On or about January 26, 2022, and at times prior thereto, the employer did not ensure that employee(s)/worker(s) in the performance of the contract work who operated forklifts had been trained, evaluated, and certified in accordance with 29 CFR 1910.178(l) prior to allowing them to operate forklifts exposing the employee(s) to struck-by and fall hazards.
