29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) Kurtz School Road, Stewartstown PA Residential Home -Employees on the second floor residential home worked above an employee on the ladder and employees working on the ground without wearing hard hats, exposing employees to struck by hazard, on or about January 27 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) Kurtz School Road, Stewartstown PA Residential Home - Employees performing residential framing work activities installing decking on the second floor and were exposed to a fall hazard of approximately 19 to 27 feet without the benefit of a fall protection system, on or about January 27, 2022. (b) Kurtz School Road, Stewartstown PA Residential Home - An employee worked at a second floor window pulling 2x4 from a Pettibone through an unguarded window opening at the front of the house exposing employees to a fall hazard of approximately 12 feet, on or about January 27, 2022. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
