29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) Clare Propco LLC dba The Clare located at 55 E Pearson St., Chicago, IL 60611: On or about February 7, 2022, the employer did not provide a fit test to all employees required to wear respirators. The employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR 1910.134(m)(2)(i)(C): The employer did not establish a record of the qualitative and quantitative fit tests administered to an employee which included the specific make, model, style and size of respirator tested: a) Clare Propco LLC dba The Clare located at 55 E Pearson St., Chicago, IL 60611: On or about February 8, 2022, the employer did not document on each fit test record the model and/or size of each respirator including, but not limited to, 3M N95 respirators. These omissions resulted in the inability to verify if employees were fit tested for the same respirator they were wearing. Employees were, thereby, exposed to respiratory hazards, including COVID-19.
