29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:    On or about January 27, 2022, an employee was observed receiving appliances through a wall opening on the fourth level of a commercial building, without a means of fall protection, located at, 4010 Lorain Avenue, Cleveland, Ohio 44113; the employer did not ensure the employee was protected from a fall that was 4 feet (1.2 m) or more above the lower level. The appliances were being loaded onto a telescopic hander on the ground. The telescopic handler then moved the appliances to the fourth level of the building where the exposed employee was receiving the appliances through the wall opening while exposed to the fall hazard.
