29 CFR 1910.1026(k)(1)(i)(A): The employer did not make medical surveillance available for all employees who were or could be occupationally exposed to chromium (VI) at or above the action level for 30 or more days a year: (a) Welding Area: On February 1, 2022, an employee conducting chrome plating was exposed to an airborne concentration to hexavalent chromium at an 8-hour Time Weighted Average of 5.36 micrograms per cubic meter of air for the 463 minute sampling period on February 1, 2022. The employee was exposed over the action level of 2.5 micrograms per cubic meter of air. The employer has not made a medical surveillance program available for the employee that was exposed over the action level.

29 CFR 1910.1026(i)(4)(i): Employees were allowed to consume food or beverages at a worksite where chromium (VI) was present; however, the employer did not ensure that the eating and drinking areas were maintained as free as practicable of chromium (VI): (a) Break Area, Behind Polishing Area: On February 1, 2022 and times prior, the employer did not ensure that all eating and drinking areas were as a free a practicable of hexavalent chromium. Wipe samples collected on the break table showed the presence of hexavalent chromium.
