29 CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: (1) authorized employee shall have knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy. (2) Machine or equipment shutdown. The machine or equipment shall be turned off or shut down using the procedures established for the machine or equipment. An orderly shutdown must be utilized to avoid any additional or increased hazard(s) to employees as a result of the equipment stoppage. (3) physically locate and operate the energy isolating devices in such a manner as to isolate the machine or equipment from the energy sources. (4) affix lockout or tagout devices to each energy isolating device (5) Prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergizing of the machine or equipment have been accomplished. a) On 1/23/2022 the employer did not ensure that employee(s) reaching into the running stamping area of the Soap Stamping Machine (model # USN-500/R/CW), that the electrical disconnects that powered the system were shut off and locked out prior to performing such task as clearing jams in the point of operation.

29 CFR 1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. a) On 1/23/22 the employer did not ensure that the Binacchi Soap Stamping Machine (model # USN-500/R/CW) was properly guarded in that employees were able to open a plexi glass guard with interlocks on it, while the machine was running to clear a jam.

29 CFR 1910.212(a)(3)(iii):Special handtools for placing and removing material shall be such as to permit easy handling of material without the operator placing a hand in the danger zone. Such tools shall not be in lieu of other guarding required by this section, but can only be used to supplement protection provided. a) On 1/23/2022 the employer provided a tool to employees to clear jams on the Binacchi Soap Stamping Machine (model # USN-500/R/CW) in lieu of ensuring that the interlocks on the plexi-glass guard were working properly exposing employees to a caught-in hazard.
