29 CFR  1910.212(a)(3)(ii):The  point of operation of machines whose operation exposed an employee to injury, was not guarded:  (a)OVB Holdings, LLC dba Overbuilt, Inc at 780 West Park Avenue Northwest, Huron, SD 57350:  On or about and at times prior to January 27, 2022, the employer did not ensure that the point of operation on the Beveller machine was guarded.  This condition exposed employees to caught-in hazards associated with the spinning blades.  (b)OVB Holdings, LLC dba Overbuilt, Inc at 780 West Park Avenue Northwest, Huron, SD 57350:  On or about and at times prior to January 27, 2022, the employer did not ensure that the point of operation on the 2000 Ton Overbuilt hydraulic press brake was effectively guarded. This condition exposed employees to caught-in hazards associated with the point of operation.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)OVB Holdings, LLC dba Overbuilt, Inc at 780 West Park Avenue Northwest, Huron, SD 57350:  On or about and at times prior to January 27, 2022, the employer did not ensure that the point of operation on the 2000 Ton Overbuilt Brake Press was effectively guarded in that the rear of the press was not guarded by a physical or other barrier which allowed for employees to enter the area while the brake was in operation. This condition exposed employees to caught-in and amputation hazards associated with the point of operation.  (b)OVB Holdings, LLC dba Overbuilt, Inc at 780 West Park Avenue Northwest, Huron, SD 57350:  On or about and at times prior to January 27, 2022, the employer did not ensure that the point of operation on the Cincinnati 7 Brake Press was effectively guarded in that the rear of the press was not guarded by a physical barrier which allowed for employees to enter the area while the brake was in operation. This condition exposed employees to caught-in and amputation hazards associated with the point of operation.
