29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by hazards:  On or about February 1, 2022, and times prior thereto, the employer did not ensure powered industrial truck operators wore seatbelts in the following instances:   a) Crown Electric Forklift #19 adjacent to Aisle AC. b) Toyota Electric Forklift #9 adjacent to Aisle AG.

29 CFR  1910.178(m)(5)(i):When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set.  On or about February 1, 2022 and times prior there to, the employer did not ensure employees lowered the forks and loaded materials to the ground prior to powering off the powered industrial truck and leaving the vehicle unattended during the following instances:  a) Crown Reach truck #2 in Aisle AL b) Crown Reach truck #20 in Aisle AM c) Crown Reach truck #1 in Aisle AK

29 CFR  1910.178(m)(5)(ii):A powered industrial truck is unattended when the operator is 25 ft. or more away from the vehicle which remains in his view, or whenever the operator leaves the vehicle and it is not in his view.  On or about February 1, 2022 and times prior there to, the employer did not ensure employees powered off their assigned powered industrial trucks when they dismounted the vehicle and it was no loner in their field of view or were more than 25 feet away from the powered on lift in the following instances:  a) Walk Behind Electric Pallet Jack #12, unattended and out of field of view of operator near Aisle AA-AB b) Toyota Stand Up Lift #6, unattended, out of field of view and more than 25 feet from operator near Aisle AD c) Toyota Stand Up Lift # 8, unattended, out of field of view and more than 25 feet from operator near Aisle AF d) Crown Stand Up #2 left unattended out of field of view of operator near Aisle AL
