29 CFR  1926.150(a)(1):  The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and did not provide for the firefighting equipment as specified in this subpart:  a) Lot 46-47 of The Canal District at Fort Dupont Development in Delaware City, DE 19706: On or about January 28, 2022, the employer did not provide a fire protection program on site where employees worked with flammable materials including but not limited to gasoline, wood, paper and ignition sources were present including but not limited to heat and spark producing equipment without ensuring that a required fire protection program was addressed and the employees knew what to do in the event of a fire.  Furthermore, employees were working on elevated areas of the building with limited access that exposed the employees to further hazards.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a) Lot 46-47 of The Canal District at Fort Dupont Development in Delaware City, DE 19706: On or about January 28, 2022, the employer failed to ensure employees had and used fall protection while working approximately 10 feet above the grade, exposing employees to fall hazards.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) Lot 46-47 of The Canal District at Fort Dupont Development in Delaware City, DE 19706: On or about January 28, 2022, the employer did not report an in-patient hospitalization as required within 24-hours. The employer reported the incident to OSHA on January 31, 2022.
