29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) 258 E. Scotland Road Bear, DE. - On or about February 3, 2022 the employer failed to ensure employees  performing paint spraying operations  on the rail cars  and wearing 3M elastomeric negative pressure 1/2 face respirators are provided a medical evaluation from a medical professional [e.g. occupational physician, nurse, physician assistant, etc.].

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  a) 258 E. Scotland Road Bear, DE - On or about  February 3, 2022, the employer did not ensure that employees wearing 3M tight-fitting, negative pressure, half-face respirators for spray painting the underside of the  rail cars were fit tested prior to initial use of the respirator.

29 CFR  1910.134(k)(5): Respiratory protection retraining was not conducted annually:   a) 258 E. Scotland Drive Bear, DE - On or about February 4, 2022, the employer did not provide respiratory protection training to employees prior to requiring them to  perform spray painting operations on the underside of the rail cars while operating the new Wagner 2100 series airless sprayer.   Abatement Note:  The employer must provide effective training to employees who are required to use respirators, as outlined in paragraph 1910.134(k)(1)-(6); to include but not limited to:  Why the respirator is necessary and how improper fit, usage, or maintenance can compromise the protective effect of the respirator;   What the limitations and capabilities of the respirator are;   How to use the respirator effectively in emergency situations, including situations in which the respirator malfunctions;   How to inspect, put on and remove, use, and check the seals of the respirator;   What the procedures are for maintenance and storage of the respirator;   How to recognize medical signs and symptoms that may limit or prevent the effective use of respirators; and   The general requirements of this section.   The training shall be conducted in a manner that is understandable to the employee.   The employer shall provide the training prior to requiring the employee to use a respirator in the workplace.
