29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided: a) On or about February 1, 2022, during chimney cap access and egress without stairways or ladders, employees were exposed to fall hazards where there was a break in elevation of approximately 6 feet between the chimney cap and the base of the chimney at the roof line. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) On or about February 1, 2022, employees were exposed to the hazard of falling approximately 27 feet while working from the top of a masonry chimney. b) On or about February 1, 2022, employees were exposed to the hazard of falling from a pitched roof surface having a ground to eave height of approximately 21 feet. Lindemann Chimney Service, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 1469445, citation 1, item 1, and was affirmed as a final order on July 7, 2020, with respect to a worksite located at 842 N. Columbian, Oak Park, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
