29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  Europastry, USA, 571 Jersey Ave, New Brunswick, NJ - manufacturing areas:  a. The employer did not ensure adequate machine guarding was provided to prevent employees from entering or inserting body parts into machines or equipment.  Employees engaged in the manufacture of products worked at or around equipment that included, but was not limited to Bosh 11 Machine, were able to change the wrapper in the machine while the machine was running as the interlocks were removed, so the equipment did not have a physical guard and/or interlocks to stop the equipment when the guard was opened.   Violation occurred on or about January 21, 2022.

29 CFR  1904.39(a)(2): The employer failed to report an employee's  amputation, as a result of a work-related incident, to OSHA within twenty-four (24) hours.  a) Europastry USA, Inc., 571 Jersey Ave, New Brunswick, NJ - On 1/21/2022 an employee suffered injury to his right ring finger and pinkie while operating the Bosch 11 machine, resulting in avulsion/amputation.  Notification of the worker injury was not made to OSHA within 24 hours of the occurrence.  Condition noted on or about 01/21/2022.
