OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to caught in hazards: a.) On or about January 28, 2022, the employer did not ensure that employees operating equipment such as but not limited to the Powermatic 1200 20" Drill Press (SN 520V0257) were not wearing loose clothing that could be caught in the 9.25 inch deburring bit operating at a speed of 800-1,000 RPM. b.) On or about January 28, 2022, the employer did not ensure that employees deburring the bedside commode 707 frames that measured at approximately 24 inches long by 17 inches wide were not handling the parts without being placed over the table nor within a jig, but freehanding each part away from the table directly under the deburring bit running at a speed of 800-1,000 RPM. Among other methods, one feasible and acceptable means of abatement would be to follow the recommendations for Powermatic operating instructions for the Model 1200 20" Drill Press for the year 1979 and 1984. Under drill press safety instructions, #4, located on page #3 regarding not wearing loose clothing. Under drill press safety instructions, #10, located on page #3 regarding never drill freehand.

29 CFR 1910.36(g)(2): An exit access must be at least 28 inches (71.1 cm) wide at all points. Where there is only one exit access leading to an exit or exit discharge, the width of the exit and exit discharge must be at least equal to the width of the exit access. a.) On or about January 28, 2022, the employer did not ensure that employees operating the Powermatic Model 1200 20" Drill Press (SN 520V0257), were not blocked on all sides to prevent access to the main exit route located next to the drill press. The employee was surrounded by racks of bedside commode 707 frames on the north and south end and large bins on the east and west ends.
