29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) On or about February 03, 2022, and days prior to, the employer did not administer a continuing, effective hearing conservation program for employees in the Performance Packaging building while an employee was exposed to sound levels of 87.7 dBA, which exceeds the 8-hour time-weighted average sound level PEL of 85 decibels. Sampling was performed for 433 minutes and zero for the remainder. (b) On or about February 03, 2022, and in days prior to, the employer did not administer a continuing, effective hearing conservation program for employees in the Performance Packaging building while an employee was exposed to sound levels of 87.9 dBA, which exceeds the 8-hour time-weighted average sound level PEL of 85 decibels. Sampling was performed for 434 minutes and zero for the remainder.
