29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face: a) 330 Franklin Turnpike Operations LLC DBA Ridgewood Center NJ located at 330 Franklin Turnpike, Ridgewood, NJ: The use of respiratory protection, including but not limited to Makrite Sekura-N95 filtering facepiece respirators, was required for all employees in the facility for protection against the SARS-CoV-2 virus. The employer failed to ensure that employees did not have facial hair that would interfere with mask-to-face seal. The employees were required to work all over the facility including the isolation rooms for COVID-19 positive residents. The violation occurred on or about 01/28/2022 and after.

29 CFR 1910.134(k)(5)(ii): Retraining was not conducted when inadequacies in the employee's knowledge or use of the respirator indicated that the employee did not retain the necessary training or skill: a) 330 Franklin Turnpike Operations LLC DBA Ridgewood Center NJ located at 330 Franklin Turnpike, Ridgewood, NJ: On or about 02/04/22, The use of respiratory protection, including but not limited to Makrite Sekura-N95 filtering facepiece respirators, was required for all employees in the facility for protection against the SARS-CoV-2 virus. The employer did not administer retraining when he observed that employees used N95 respirators while their facial hair interfered with the mask-to-face seals compromising the protective effect of the respirators. The violation occurred on or about 02/04/22 and after.
