29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a)Firefly Builders, Inc. at 1 North 5th Avenue, Belle Fourche, SD 57717: On or about and at times prior to February 3, 2022, the employer did not ensure employees were utilizing fall protection while working from heights greater than four feet. Employees were performing sheathing operations on a prefabricated building structure inside the facility without having a fall protection system in place. This condition exposed employees to fall hazards of approximately 12 feet to the building interior and 15 feet to the building exterior.

29 CFR 1910.30(a)(1):The employer did not provide a training program for each employee who might be exposed to fall hazards: (a)Firefly Builders, Inc. at 1 North 5th Avenue, Belle Fourche, SD 57717: On or about and at times prior to February 3, 2022, the employer did not provide a training program that protected employees when working four feet or more above a lower level. Four employees were required to work from heights greater than four feet while installing roof sheathing on a prefabricated building structure in a production facility and were not properly trained in the use of fall protection equipment, fall protection requirements or fall hazard recognition. This condition exposed the employees to injury related to fall hazards up to 15 feet to concrete below. Abatement Note: Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. 1. The employer must ensure that each employee is trained by a qualified person. 2. The employer must train each employee in at least the following topics: a. The nature of the fall hazards in the work area and how to recognize them. b. The procedures to be followed to minimize those hazards. c. The correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems that the employee uses. d. The correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer.

Employees were operating a Hyster Model S120XL, Serial # D004V03999L to move materials to facilitate building of prefabricated building structures without being trained or evaluated by the employer. This condition exposed employees to struck-by and crushed-by hazards associated with improper powered industrial truck operation.

29 CFR 1910.134(c)(2)(i): The employer did not provide voluntary respirator users the information contained in Appendix D to this section: (a)Firefly Builders, Inc. at 1 North 5th Avenue, Belle Fourche, SD 57717: On or about and at times prior to February 3, 2022, the employer permitted the voluntary use of filtering face piece respirators. The employer did not provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"). This hazard exposed employees to respiratory hazards while voluntarily utilizing a filtering face piece during wood sawing operations. Abatement Note: If the employer determines that any voluntary respirator use is permissible, the employer must provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); as well as other information as required by 1910.134.
