29 CFR 1910.37(a)(4): Safeguards designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: (a)FedEx Ground Package Systems, Inc., at 3514 Galt Court, Rapid City, SD 57701: On or about and at times prior to February 2, 2022, the employer did not ensure that multiple battery backup emergency pathway lighting systems throughout the facility were operational under battery power in the event of a power outage. This condition exposes employees, particularly those working in hours of darkness, to tripping and stuck-by hazards while attempting to egress the facility in the event egress is required during a power outage or emergency.

29 CFR 1910.37(b)(6): Each exit sign was not illuminated to a surface value of at least five foot-candles (54 lux) by a reliable light source and be distinctive in color: (a)FedEx Ground Package Systems, Inc., at 3514 Galt Court, Rapid City, SD 57701: On or about and at times prior to February 2, 2022, the employer did not ensure employees were protected from hazards associated safe egress in that battery backup exit signs would not illuminate in the event of a power outage. This condition exposed employees, particularly those working in hours of darkness to hazards associated with not being able readily identify the exit of their work area in an expedient manner in the event of a fire or other emergency during a power outage.

29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment: (a)FedEx Ground Package Systems, Inc., at 3514 Galt Court, Rapid City, SD 57701: On or about and at times prior to February 2, 2022, the employer did not ensure that a primary power breaker panel, number L3, was readily accessible, in that a portable hydraulic trailer jacking system was placed in front of the panel, which effectively blocked access in the event of an electrical emergency. This condition exposed employees to potential shock and electrocution hazards.
