OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the industry recognized crushing hazards of tip-over while operating a powered industrial truck without utilizing the restraint device.  (a) Yard: On or about February 3, 2022 and times prior, an employee would operate a Lift King Forklift (Model LK  10M42) without utilizing its equipped seat belt.
