29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   a)  At 10974 Catania Avenue, Lot 150 The Verandas, Fairhope, Alabama:  On or about February 8, 2022; the employer allowed his employees to operate pneumatic nail guns without eye protection while performing framing activities exposing his employees to struck-by hazards.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 10974 Catania Avenue, Lot 150 The Verandas, Fairhope, Alabama:  On or about February 8, 2022; the employer allowed his employees to perform roofing activities without fall protection exposing his employees to a fall hazard of up to 15 feet 9 inches to the ground below.  The Wilbert Perez dba Wilbert Perez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(B)(13) which was contained in OSHA inspection number 1505620, citation number 1, item number 1, group a and was affirmed as a final order on February 9, 2021 with respect to a workplace located at 31310 Buckingham Blvd., Churchill Subdivision, Spanish Fort, Alabama.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a)  At 10974 Catania Avenue, Lot 150 The Verandas, Fairhope, Alabama:  On or about February 8, 2022; the employer allowed his employees to perform roofing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 15 feet 9 inches to the ground below.  The Wilbert Perez dba Wilbert Perez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(A)(1) which was contained in OSHA inspection number 1505620, citation number 1, item number 1, group b and was affirmed as a final order on February 9, 2021 with respect to a workplace located at 31310 Buckingham Blvd., Churchill Subdivision, Spanish Fort, Alabama.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At 10974 Catania Avenue, Lot 150 The Verandas, Fairhope, Alabama:  On or about February 8, 2022; the employer allowed his employees to use an extension ladder to gain access to the roof and the rails of the ladder did not extend three feet above the roof landing to provide safe access exposing his employees to a fall hazard of 14 feet 1 inch to the ground below.  The Wilbert Perez dba Wilbert Perez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(B)(1) which was contained in OSHA inspection number 1505620, citation number 1, item number 1, group c and was affirmed as a final order on February 9, 2021 with respect to a workplace located at 31310 Buckingham Blvd., Churchill Subdivision, Spanish Fort, Alabama.
