29 CFR  1926.1427(f)(1)(i): Through an evaluation, the employer did not ensure that each operator was qualified by a demonstration of the skills and knowledge, as well as the ability to recognize and avert risk, necessary to operate the equipment safely, including those specific to the safety devices, operational aids, software, and the size and configuration of the equipment. Size and configuration includes, but is not limited to, lifting capacity, boom length, attachments, luffing jib, and counterweight set-up:  a)	Seaward Marine Corporation: On or about 02/07/2022, the crane operator was not thoroughly evaluated to avert risk in that the employee occasionally traveled with a load while on the floating barge.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

No abatement certification or documentation required.

29 CFR  1926.1437(n)(5): The physical attachment, corralling, rail system, or centerline cable system did not meet the requirements of options 1 through 4 of this section, or meet the requirements of paragraph (n)(5)(v) of this section:  a)	Seaward Marine Corporation: On or about 02/08/2022, the employer failed to have a marine engineer, registered professional or a qualified person designed the centerline cable system used in preventing the crane from shifting.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1437(n)(5)(iv)(D): Means were not installed to prevent the crane/derrick from passing the forward or aft end of the wire rope attachments:  a)	Seaward Marine Corporation: On or about 02/08/2022, adequate means were not installed to prevent the crane from passing the wire rope attachments in that  the crane when passing the aft end wire rope attachment, snapped the wire and the crane went off the stern of the barge.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR  1926.1437(n)(5)(v): The systems/means of securement of the crane to the barge used to comply with options 1-4 of this section were not designed by a qualified person familiar with floating crane/derrick design:   a)	Seaward Marine Corporation: On or about 02/08/2022, the employer used option 4 to secure the 330-ton Liebherr Crawler crane, Model LR 1300.1 SX, Serial #138591 crane onto the Carolyn Skaves barge without a qualified person.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
