29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) Building #5 of apartment complex.  On or about February 9, 2022, employees were exposed to a struck-by hazard, as they attached roof shingles with pneumatic guns, without using proper eye protection.  b) Building #6 of apartment complex.  On or about February 28, 2022, employees were exposed to a struck-by hazard, as they attached roof shingles with pneumatic guns, without using proper eye protection.  c) Building #1 of apartment complex.  On or about March 9, 2022, employees were exposed to a struck-by hazard, as they attached roof shingles with pneumatic guns, without using proper eye protection.  Mario Espinale was previously cited for a violation of this occupational safety and health standard 1926.102(a)(1) which was contained in OSHA inspection number 1539740, citation number 1, item number 1 and was affirmed as a final order on September 30, 2021, with respect to a workplace located at 1904 Sorvino, Leander, TX 78641.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Building #5 of apartment complex.  On or about February 9, 2022, and at times prior thereto, employees were exposed to a fall hazard of greater than 6 feet to the ground below, while performing roof work, without wearing fall protection.   b) Building #6 of apartment complex.  On or about February 28, 2022, and at times prior thereto, employees were exposed to a fall hazard of greater than 6 feet to the ground below, while performing roof work, without  wearing fall protection.  c) Building #1 of apartment complex.  On or about March 9, 2022, and at times prior thereto, employees were exposed to a fall hazard of greater than 6 feet to the ground below, while performing roof work,  without wearing fall protection.  Mario Espinale was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1539740, citation number 1, item number 2, and was affirmed as a final order on September 30, 2021, with respect to a workplace located at 1904 Sorvino, Leander, TX 78641.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards that would enable each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards:  a) Building #5 of apartment complex.  On or about February 9, 2022, and at times prior thereto, employees were exposed to a fall hazard of greater than 6 feet to the ground below, while performing roof work, without effective training in recognizing and avoiding the fall hazards.   b) Building #6 of apartment complex.  On or about February 28, 2022, and at times prior thereto, employees were exposed to a fall hazard of greater than 6 feet to the ground below, while performing roof work, without effective training in recognizing and avoiding the fall hazards.  c) Building #1 of apartment complex.
