29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator: (Construction Reference 1926.103) a.) Con Yeager Spice Company, LLC; Packaging Room - On or about, 2/9/22 and times prior thereto, employees voluntarily wore half mask air-purifying respirators (Honeywell brand; P100 cartridges) during spice packaging operations onsite. The employees were not provided with a medical evaluation prior to the use of the respirators. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (Construction Reference 1926.103)(a) a.) Con Yeager Spice Company, LLC; Packaging Room - On or about 2/9/22 and times prior thereto, employees voluntarily wore half mask air-purifying respirators (Honeywell brand; P100 cartridges) during spice packaging operations onsite. The employer did not establish portions of a Respiratory Protection Program that covered medical evaluations and respirator maintenance and care. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
