29 CFR 1910.147(c)(7)(i): The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: On or about February 2, 2022, at a workplace located at 2358 West Packard Street, Appleton, WI in the Bella Drying Room: employees were not provided training on the safe application of energy isolation, the correct cord and plug configuration for powered equipment, nor the gravity of hazard(s) associated with failure to de-energize equipment.

29 CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence as required by 29 CFR 1910.147(d)(1)-(6): On or about February 2, 2022, at a workplace located at 2358 West Packard Street, Appleton, WI in the Bella Drying Room: employees were exposed to machine hazards associated with moving parts when they engaged in troubleshooting the Marchant Schmidt incline screw auger. The employer did not ensure that employees implemented energy control application steps prior to allowing them to troubleshoot the machine exposing them to pinch point hazards created by the rotating auger. The machine was not deenergized prior to the employee engaging in the servicing/maintenance activity. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.: On or about February 2, 2022, at a workplace located at 2358 West Packard Street, Appleton, WI in the Bella Drying Room: the discharge chute on the Marchant Schmidt incline screw auger used in conjunction with the Fitz Mill grader was not guarded to prevent employee exposure to the pinch point hazard created by the rotating auger blade and the exterior enclosure.
