29 CFR 1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.   On or about February 10, 2022 at job site located in 617 Berkley Ave., Elmhurst, IL 60126, The employer did not ensure that employee working inside an excavation at approximately 12 feet in depth  was using head protection. Employee was exposed to struck-by hazards from debris and employees working on the ground level when the employer failed to ensure a hardhat was utilized.  Abatement certification is required for this item in accordance with 29 CFR 1903(c).

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a)	On or about February 10, 2022 at job site located in 617 Berkley Ave., Elmhurst, IL 60126, an employee was not protected from cave-ins while entering and exiting the unprotected section of the excavation, therefore exposing employee to hazards associated with cave-ins. The employer failed to ensure cave-in protection was utilized. b)	On or about February 10, 2022 at job site located in 617 Berkley Ave., Elmhurst, IL 60126, the top of the trench box used was positioned below ground level, exposing an employee working in the trench to cave-in hazards from overtop of the box.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations shall be in written form at the jobsite during construction of the protective system. After that time this data may be stored off the jobsite, but a copy shall be made available to the Secretary upon request.   On or about February 10, 2022 at job site located in 617 Berkley Ave., Elmhurst, IL 60126, the  employer did not maintain a copy of the tabulated data sheet of the trench box utilized when employees engaged in excavating activities, nor was it provided upon request.  The trench box was built with three spreader bars.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.652(g)(2):Excavation of material to a level no greater than 2 feet (.61m) below the bottom of a shield system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the shield.  On or about February 10, 2022 at job site located in 617 Berkley Ave., Elmhurst, IL 60126, an employee engaged in excavation  activities  while working in a trench approximately 12 feet in depth  was exposed cave- in hazards as the trench was dug to a depth of approximately 3 feet 3 inches below the bottom of the trench box.   Additional shield system was  not utilized.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
