29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   On or about February 11, 2022, and at times prior thereto, employees  were exposed to a struck-by hazard, while a JLG Telescopic Forklift was being operated by person who was not trained to operate it in its safe operation.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   Front Entrance: On or about February 11, 2022, an employee was exposed to an ejection hazard, while operating a JLG Telescopic Forklift while not utilizing the required seatbelt.
