OSH ACT of 1970 Section (5)(a)(1): Employees were exposed to structurally damaged, not properly anchored, and leaning warehouse pallet racks: (a) On or about February 10, 2022, all across the warehouse area, employees engaged in warehousing work were exposed to struck-by and crush-by hazards. The employer did not ensure that the metal pallet racks were properly anchored to the floor; many rack columns were missing foot plates, and struts were bent, twisted, torn, rusted, structurally damaged, or out of plumb and straight allowances. Among other methods, feasible and acceptable methods to correct theses hazardous conditions would be: 1. Adhere to the recommendations in accordance with Consensus Standard ANSI MH16.1-2012, Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks: - Section 1.4.1, "The owner shall maintain the structural integrity of the installed rack system by assuring proper operational, housekeeping, and maintenance procedures including, but not limited to, regularly inspecting for damage." - Section 1.4.7, "The bottom of all columns shall be furnished with column base plates"; "All rack columns shall be anchored to the floor with anchor bolts." - Section 1.4.9, "Upon any visible damage, the pertinent portions of the rack shall be immediately isolated by the user until the damaged portion is evaluated by a storage rack design professional." - Section 1.4.11, "Out-of-plumb and Out-of-straight limits should be unloaded and replumbed, and any damaged parts must be repaired or replaced."

29 CFR 1910.178(p)(1): Powered industrial trucks found to be in need of repairs, defective, or in any way unsafe had not been taken out of service until restored to safe operating conditions: (a) On or about February 10, 2022, at the warehouse and loading/unloading dock areas, the employer fail to remove from service a Toyota, electric, Powered Industrial Truck, model number 7BNCU20 and serial number 51329; and allowed it to operate with worn-out tires. (b) On or about February 10, 2022, at the warehouse and loading/unloading dock areas, the employer fail to remove from service Toyota, propane gas, Powered Industrial Truck, model number 7EGCU25 and serial number 61190; and allowed it to operate with worn-out tires. NOTE: Certification and documentation of abatement must be submitted for this citation item as required by CFR 1903.19(c) and (d), respectively.
