29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a)Siteworks, Inc. at the Hartford Industrial District Sewer Expansion Project, Hartford, SD 57033: On or about and prior to February 15, 2022, the employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions related to unprotected excavations, failure to utilize provided PPE, spoils piles, and ladder use. These conditions exposed employees to cave-in hazards as a result of working in an excavation with vertical unsupported walls over five feet, struck-by hazards associated with spoils materials, overhead hazards, and fall hazards related to ladders.

One employee was observed directly below the multiple hazardous conditions that could lead to a struck-by injury.

29 CFR 1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: (a)Siteworks, Inc. at the Hartford Industrial District Sewer Expansion Project, Hartford, SD 57033:On or about and prior to February 15, 2022, the employer did not ensure spoils piles were positioned two feet or greater from the edge of the trench excavation where an employee was in the trench performing work. Large frozen chunks of soil were on the excavation edge and could have resulted in severe struck-by injuries to employees below. This condition exposed employees to struck-by and crushing hazards.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)Siteworks, Inc. at the Hartford Industrial District Sewer Expansion Project, Hartford, SD 57033: On or about and prior to February 15, 2022, the employer did not ensure that each employee conducting work in an excavation was protected from cave-in, in that the excavation was measured at 11.8 feet deep and lacked an adequate protective system, such as appropriate sloping, benching, or shield system. Employees accessed the trench excavation to install sewer pipe. This condition exposed one employees to cave-in and struck-by hazards when performing work in a 11.8 -feet deep excavation. Siteworks was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1257122, citation number 1, item number 4b and was affirmed as a final order on June 11, 2018, with respect to a workplace located at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a)Siteworks, Inc. at the Hartford Industrial District Sewer Expansion Project, Hartford, SD 57033: On or about and prior to February 15, 2022, the employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not identify current soil conditions, did not identify the need for a trench protective system, and did not ensure appropriate protective system was in place prior to an employee entering the excavation. This condition exposed the employee to struck-by and crushed-by hazards when performing work in the unprotected excavation at an approximate depth of 12-feet. Siteworks, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1257122 , citation number 1, item number 4 and was affirmed as a final order on June 11, 2018, with respect to a workplace located at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110.
