29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. On or about February 10, 2022, the employer failed to ensure that powered industrial vehicle operators receive refresher training immediately following an accident. Employees working in the production area were exposed to struck-by hazards associated with the Crown #3 6000-pound PIV. An operator of the Crown #3 PIV immediately returned to work and continued to operate the PIV without refresher training.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. On or about February 10, 2022, the employer failed to ensure that powered industrial vehicle operators receive an evaluation of the PIV operator's performance at least once every three years. Employees working in the production area were exposed to struck-by hazards. An audit of PIV operators training records showed deficiencies in the currency rate of at least once every three years for PIV operators.

29 CFR 1910.178(n)(6):Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: On or about February 10, 2022, the employer failed to ensure that powered industrial vehicle operators looked in the direction of travel and kept a clear path of travel. Employees working in the production area were exposed to struck-by hazards associated with PIV operations. By failing to maintain a clear path of travel, an employee incurred several lacerations and fractures to their lower extremities.
