29 CFR  1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with nails and all other debris were not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:   (a) First Floor, Front Entry:  On or about February 10, 2022, employees were accessing the work area, where there were piles of scrap lumber (some with nails), trash, tree stumps, scrap metal and other debris.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a) First Floor- On or about February 10, 2022, carpenters that were performing framing activities using tools, such as but not limited to a Plaslode pneumatic nail gun and DeWalt Flexvolt Brushless circular saw while there was a worker below providing materials and supplies was not wearing a hard hat.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)  Front, 2nd Floor - On or about February 10, 2022, carpenters were not wearing eye protection while operating portable hand tools such as, but not limited to, a Plaslode pneumatic nail gun, DeWalt Flexvolt Brushless circular saw and DeWalt Flexvolt screw drill while performing framing activity.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) First Floor:  On or about February 10, 2022, employee was exposed to a fall hazard of approximately 9 feet while handing equipment to an employee on the second floor.  (b) Second Floor: On or about February 10, 2022,  employees that were performing framing activity were exposed to a fall hazard of approximately 19-feet.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) First Floor:  On or about February 10, 2022,  the employer had not provided a fall protection training program to employees that were exposed to a fall hazard of 9 -feet while conducting frame out work.  (b) Second Floor:  On or about February 10, 2022,  employer had not provided a fall protection training program to employees that were exposed to a fall hazard of 19-feet while conducting frame out work.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
