OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees Storage rack numbers B04, B05, D04, I 04: On or about February 17, 2022, and at times prior thereto the employer failed to anchor and bolt down storage racks to prevent employees from exposure to struck-by and/or crush hazards when working near storage racks. Additionally, the employer failed to repair or replace damaged or bent racks.

29 CFR 1910.176(b):Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers were not stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse. On or about February 17, 2022 stored material, pallets of heavy metal trailer parts, were not securely stored on storage racks up to approximately 10 feet above ground level. Pallets and storage rack cross boards hanging off edge of the storage racks has the potential of falling, exposing employees to struck by and/or crushing hazard.

29 CFR 1910.303(g)(1)(i)(A):The depth of the working space in the direction of access to live parts was less than indicated in Table S-1. Distances shall be measured from the live parts if they are exposed or from the enclosure front or opening if they are enclosed; On or about 02/17/22 employees were exposed to a hazard, denial of access to an electrical panel in event of an emergency because of obstructions (metal electrical fan) being placed closer than 36 inches in front of an open electrical panel carrying <600V.
