29 CFR 1904.35(b)(1)(iv): The Employer discriminated or retaliated against the employee for reporting a work-related injury or illness:  U.S. Postal Service located at 15210 Dino Drive Burtonsville, MD 20866  (a) On or about January 20, 2022, the employer terminated a City Carrier Assistant because the employee reported a work-related injury of a broken left Fibula.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1904.40(a): Basic requirement. When an authorized government representative asks for the records, you keep under Part 1904, you must provide copies of the records within four (4) business hours:  U.S. Postal Service located at 15210 Dino Drive Burtonsville, MD 20866.S. Postal Service located at 15210 Dino Drive Burtonsville, MD 20866:  (a) On or about February 23, 2022, the employer failed to provide copies of OSHA 300 and 300A records or their equivalents, were requested for calendar years 2019, 2020, 2021 and 2022 within four (4) hours.  The U.S. Postal Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.40(a), which was contained in OSHA inspection number 1498099, citation number 2, item number 1 and was affirmed as a final order on December 11, 2020, with respect to a workplace located at 8409 Lee Hwy, Merrifield, VA 22081.  The U.S Postal Service was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.40(a), which was contained in OSHA inspection number 1426876, citation number 2, item number 3 and was affirmed as a final order on February 14, 2020, with respect to a workplace located at 600 Princess Anne Street, Fredericksburg, VA 22401.

29 CFR  1904.29(b)(2): The employer did not correctly fill out an OSHA Form 301.   a) On or about February 23, 2022, for case 25430 the employer failed to  fill out the OSHA  Form 301 in the detail required, which included:  - The employer did complete the form to include the  who completed the form, their title, phone number, and the date that the form was completed.  - The employer did complete section 12 to include the time employee began work.   - The employer did not complete section 14 to include what the employee was doing before the Incident occurred.  - The employer did not complete section 16 with the actual injury where the employee broke his left ankle fibula. However, the employer recorded 'Foot- Left- Sprain, sprain, twist'.   - The employer did not complete section 17 to include the object or substance that directly harmed the employee, which was  was not provided.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1904.29(b)(3): Each recordable injury or illness was not recorded on the OSHA 300 Log and 301 Incident Report within seven calendar days of receiving information that a recordable injury or illness has occurred:  U.S. Postal Service located at 15210 Dino Drive Burtonsville, MD 20866  (a) On or about January 14, 2022, the employer did not record a work-related illness, case #25430, on the OSHA 300 Log within 7 days of the injury.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
